 Buying a house in Spain

 You found the house or apartment of your dreams, what are the procedures?

The actual buying process is divided in three phases:

  • Making an offer
  • Entering in a private contract
  • Completion at the closing table.

You can do some investigation yourself. Check the "valor cadastral" and see if the fiscal value is not over-rated. You may do that at the local council. Don't be too surprised if the property is not registered at all.

 

It is important to realize that by making a offer, if accepted by the seller, you are engaged in a binding agreement. It is normal practice that a deposit is made to assure the seller that you are serious. The offer is made to the real estate agent, who will inform the seller. If the seller agrees to your offer, a private contract will be made. It sets forth all conditions of the sale and if there are any debts on the property. Usually the property will be sold without any liens and tax debt, unless otherwise agreed .

The grand finale is at the notary, where the title deeds are signed and the payment is made. Then all transfer taxes and fees are paid to the tax offices. Next is that the notary will register the transfer of ownership at the Land Registry. This registration may take a while, you can ask for a copy of the records from your notary, it's called "copia simple"
